TURKISH TOBACCO LAW
Article 1: The aim of this law is to prevent the individuals from the
harmful effects of tobacco and its products including the advertisements
and promotions.
Article 2: Smoking is not permitted in public places giving health,
education and cultural services, public transportation, waiting rooms of
public transportation means, civil service premises where five or more
people are employed. Separate areas should be designated for smokers at
above mentioned places. Isolation precautions and air conditioning
should be done to secure smoke-free zones.
Article 3: Advertisements, promotions, campaigns of any sort using trade
names, logo, and sign of tobacco and tobacco products are not permitted.
Tobacco and tobacco products can not be sold to people under 18 years of
age.
Article 4: At places where smoking is not permitted, notice signs with
at least 10 cm fonts, clearly stating the restriction and penalty should
be hung where it can be visible. The person or persons in charge of the
institution will be responsible for the warnings.
The package of tobacco products both produced in Turkey or imported
should carry easily readable and obviously visible health warnings
saying: "Legal Warning: Harmful to Health". The tobacco products not
carrying these warnings can not be imported or sold. This article is not
applicable to products sold in duty-free shops.
Turkish Radio and Television Institute and all private TV channels have
to make programs on health hazards of tobacco to warn and educate public
for at least 90 minutes each month.
Article 5: The people who smoke at places where smoking is not permitted
and where there are warning signs, shold be warned by the people in
charge of the institution or place or asked to leave the premises if
continues to smoke. If he still continues to smoke should be foreced to
leave by police force.
Article 6: If the person in charge of the institution where smoking is
not allowed, does not apply to his responsibilities , should be given a
penalty of 10 million Turkish liras. ( 100 dollars) If the responsible
person warns the smoker and if they do not apply the rules then they
should be given the same penalty.
Article 7: The ones who do not obey the first part of article 3, and the
second part of article 4, should be given a penalty of 10- 500 million
Turkish liras (100- 5000 dollars). If recurred the penalty should be at
the highest level.
Article 8: The penalty will be given by the highest state officer of the
region.
Transient article 1: The products that had been produced before the
issue of this law can be sold for one year.
Transient article 2: The separation of smoking and nonsmoking places and
the removal of the advertisement boards should be completed in one year
after the issue of the law.
Article 9: This law will be valid at the date of issue.
Article 10: The law will be followed up and monitored by the government.
