Market share for filter cigarettes increased from less than 1% in 1950 to 19% in 1955,

51% in 1960, 80% in 1970, 92% in 1980, and 95% in 1990. Low tar and nicotine

brands increased from 2% in 1965 to 45% in 1980, 56% in 1989, and 69% in 1992.

The latter products were offered as an alternative between smoking conventional

brands on one hand and quitting altogether on the other hand.

The Cigarette Labeling and Advertising Act of 1965 was an important victory for the

tobacco industry. In return for the weak warning label "cigarettes may be hazardous to

your health," federal preemption of state and local regulation on advertising went into

effect. This meant that no state or local government could pass a more restrictive

advertising ban than the federal government; the ban continues in effect more than 30

years later.

The banning of cigarette ads on TV in 1970 was at the request of and with the support

of the tobacco industry, and was followed by a rise in cigarette sales. The industry

had just seen the most dramatic drop in smoking ever due to the anti-smoking public

service announcements required by the Fairness Doctrine of 1967. The rise in sales

came immediately following the removal of anti-smoking public service

announcements from television, strong evidence that counteradvertising is effective in

altering behavior.

In 1969, America's two most popular medical shows, Ben Casey and Dr. Kildare,

were both sponsored by tobacco companies.
