Right Honorable Mr. Kirti Nidhi Bista, State Vice-Chairman and Minister for Health and Population Ministry of Health and Population State Vice-Chairman''s Secretariat His Majesty''s Government of Nepal Singh Durbar, Kathmandu, Nepal E-mail: c/o kcganesh@hotmail.com Honorable Mr. Ramesh Nath Pandey Minister for Foreign Affairs Ministry of Foreign Affairs His Majesty''s Government of Nepal Shital Niwas, Maharajgunj, Kathmandu, Nepal E-mail: fmo@mofa.gov.np Fax: ?1-4428022 Your Excellency State Vice-Chairman and Health Minister Mr. Kirti Nidhi Bista Your Excellency Mr. Ramesh Nath Pandey, Minister of Foreign Affairs We are pleased to write this petition letter for your generous consideration to ratify the FCTC before November 8, 2005. Also, we are pleased to remind you that Nepal has already signed the FCTC on December 2004 so as to ratify the FCTC prior its deadline date, i.e., November 8, 2005. Nepal needs to ratify the FCTC showing it''s strong political will and governmental commitment that protect 2.4 million Nepalese populations from tobacco-related death and diseases, such as: heart, stroke, diabetes, cancer, lung and chronic obstructive pulmonary diseases, etc. We are also pleased to remind you that all SAARC member countries EXCEPT Nepal have already been ratified the FCTC and regulated tobacco control act and legislation in a speedy manner. Bhutan has already declared itself as a pioneer tobacco-free country in Asia and protects their people from tobacco related diseases in this millennium. Also, China and India have ratified the FCTC and contributed the total population protected by the Treaty is now over four billion population, more than half the world''s population. However, Nepal is far behind to ratify the FCTC as its closed neighbors countries China, India, Pakistan, Bangladesh, Sri Lanka, Bhutan and Maldives have already ratified the FCTC and being implemented tobacco control legislation and act. The first global public health FCTC has already been signed by 168 nations and ratified by 92, making it one of the most rapidly embraced treaties in United Nations history. The target of 100 Parties by November 8, 2005 and we sincerely hope that Nepal also should be included in this target. Prestigious international organizations such as the WHO and the World Bank have concluded, based on their comprehensive research, that tobacco trade is actually an obstacle to economic and social development. Tobacco does not contributes to the elimination of poverty, rather it exacerbates it. The benefits and the profits of tobacco do not go to the farmers, who are often very indebted. Only a few people profit from tobacco: those in the tobacco industry. The tobacco industry has known for decades that the products they sell kill half of their regular customers. It knows that the products they sell are extremely addictive. Despite this fact, it has decided to ignore this information to continue selling its products and expanding its business. The industry has not hesitated to pay researchers, influence governments and undermine international organizations in the course of its activities, always with the objective of increasing its profits. In short, the tobacco industry continues to demonstrate a complete disregard for ethical principles. The WHO FCTC has provisions that set international standards on tobacco price and tax increases, tobacco advertising and sponsorship, labeling, illicit trade and second-hand tobacco smoke among others. In short, the ratification of the WHO FCTC by Nepal will allow: the increase of high taxes on tobacco products that should be utilized for the implementation of tobacco related diseases control intervention and advocacy programs; the reduction of poverty through reducing the high social and health costs currently incurred due to tobacco-related death and disease; and the continued worldwide recognition of the prestige and leadership that Nepal built during the WHO FCTC negotiations. By not ratifying the FCTC, Nepal will be denied the opportunity to receive technical and financial aid made available through the WHO FCTC and international organizations, and Nepal will send a message to the international community that its political commitments lies with the tobacco industry and not with the health of its people and the sustainable development of the country. With this letter, we appeal and urge to your sense of responsibility as political and government leaders and as human beings and urge you to ensure that Nepal ratifies the WHO FCTC immediate prior deadline in order to participate as a full Party in the first meeting of the WHO FCTC Conference of the Parties (COP) in February. Otherwise Nepal will not be able to participate as full Parties in the governing body for the WHO FCTC, the Conference of the Parties (COP). Hence, Nepal must deposit the instrument of ratification (or equivalent) in New York by 8 November 2005 to participate with full powers in the first Conference of the Parties. Yours sincerely,
